1. Who you are contracting with
These Terms & Conditions are between you and Hunter Vandeboe, operating as Review360 ("Review360", "we", "us"). Review360 provides website health monitoring, uptime checks, accessibility auditing, and related reporting services (the "Service"). By creating an account, running a scan, or continuing to use the Service, you agree to these terms. If you use the Service on behalf of a business, you confirm you have authority to bind that business; if you are an individual, you confirm you are of legal age.
2. The Service
Review360 scans websites and uploaded documents on a scheduled or on-demand basis and reports findings such as downtime, SSL issues, broken links, SEO gaps, performance problems, and accessibility barriers. We grant you a limited, non-exclusive, non-transferable right to use the Service within the limits of your selected plan (sites, scans, document checks, and features vary by plan).
The Service is informational. Accessibility and compliance findings help you identify issues, but do not by themselves guarantee legal compliance (including ADA or WCAG conformance). You are responsible for reviewing findings and deciding how to act on them.
3. Your account and acceptable use
You agree to:
- Provide accurate information and keep it up to date.
- Keep your account credentials confidential; you are responsible for activity under your account.
- Only scan websites and upload documents you own or are authorized to test.
You must not misuse the Service, including:
- Unlawful use, fraud, or spam.
- Infringing intellectual property rights.
- Interfering with the Service's security or infrastructure (malware, probing, scraping, or scanning targets you are not authorized to test).
- Reverse engineering the Service, reselling or redistributing it, or circumventing plan limits and technical restrictions.
4. Intellectual property
We retain all ownership of the Service and its intellectual property, including the software, scan engine, scoring methodology, documentation, and Review360 branding. Content you submit (sites, documents) remains yours; you grant us a limited license to host and process it solely to provide the Service. Reports generated for your account are yours to use internally.
5. Payments, subscriptions, and refunds
Paid plans are billed by our online reseller Paddle. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically until cancelled; you can cancel any time from your billing page and keep access until the end of the paid period. See our Refund Policy for refund terms.
6. Service level and warranties
We work hard to keep Review360 reliable, but we do not guarantee uninterrupted or error-free performance, and scan results may occasionally be incomplete or inaccurate. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
7. Liability
To the fullest extent permitted by law, we are not liable for indirect, consequential, or special damages (including lost profits, lost data, or loss of goodwill). Our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where the law does not allow it.
8. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. When your access ends, your monitoring stops; you may contact us within 30 days to request an export of your report data, after which it may be deleted.
9. General
These terms are governed by the laws of the State of New York, USA, and disputes will be handled in the courts there. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not responsible for delays caused by events beyond our reasonable control.
